Competition Law Disclaimer
UBA represents the interests of advertisers and is a forum for legitimate contacts between the various parties of the advertising industry. Both UBA and its members, including representatives and employees, are committed to full compliance with all applicable competition laws and fair trade practices. Members acknowledge that full compliance with competition law is a condition of membership.
All members and participants in any of the UBA activities are individually responsible for ensuring compliance with competition law. Membership to UBA and participation in UBA meetings, events, or any other activities shall not be used to engage in conduct that promote or facilitate any anti-competitive behaviour*.
UBA will carry out regular checks and reminders to ensure the competition law compliance. Any members shall promptly report any concerns regarding potential breaches through the appropriate channels.
*Anticompetitive behaviour includes, but is not limited to any discussions, agreements or activities that could restrict competition, such the exchange of commercially sensitive information, namely regarding pricing, market or customer allocation, responses to tenders.
All those attending our meetings are expected to comply with the Code of Conduct.

Competition law checklist for meetings: do's & don'ts
DO
- Review the agenda of the event in advance and limit discussions to the listed topics.
- Share only public business information.
- Keep discussions general and do not disclose or request confidential or sensitive information.
- Interrupt and object to any competition-sensitive discussions and distance yourself from them.
- Report any breach to the competent department within your organisation.
DON’T
- Do not discuss or exchange pricing information, such as current or future prices, discounts, mark-ups or other sensitive financial details.
- Do not allocate markets or customers or discuss tendering strategies.
- Do not restrict competition by engaging in conversations about limiting supply, coordinating sales or excluding competitors.
Confidentiality
Any information available on the members-only section of the UBA website is exclusively accessible to members through a personal “username” and “password” and is not made public. For this reason, UBA members who have been assigned a username and password may not, under any circumstances, distribute such information or grant access to third parties without prior written consent from an authorised UBA representative.
If the password is, for any reason, disclosed to anyone other than the person to whom it was assigned, the original assignee must immediately inform UBA in writing so that appropriate procedures can be initiated to change the password.
